Teen murder trial: No brake marks found, cop negative for drugs, says witness

IPOH: The High Court was told today that there were no brake marks on the road where Muhammad Zaharif Affendi Muhd Zamrie was struck by a Perodua Ativa driven by a senior police officer last December.

The 29th prosecution witness, Inspector Jong Pit Chao, who was the first traffic investigating officer in the case, testified that she arrived at the scene in Jalan Taman Jati 1 / Jalan Pekeliling Meru Indah on the day of the incident at 12.55pm.

"I examined the condition of the deceased at the scene. I found the victim wearing a school sports uniform lying on the roadside embraced by his sister, who was in a nurse's uniform.

"I observed injuries on the deceased's face and right elbow. His sports pants were torn at the rear," she said while reading her written statement before judge Datuk Bhupindar Singh Gucharan Singh Preet.

Jong said she conducted an inspection at the scene and found various items on the road, including fragments of vehicle components, stationery items such as pencils, scissors and a glue bottle, as well as drag marks resembling torn black fabric.

"The inspection revealed no brake marks on the road at the collision site.

"I then created a rough sketch of the scene and instructed Corporal Shahiran (police photographer) to take photographs of the location."

After the post-mortem on the Form Five student was completed at Raja Permaisuri Bainun Hospital, Jong said, she returned to the district police headquarters upon learning that the driver of the Perodua Ativa had gone there to lodge a report.

"I arrived at the office about 7.30pm and found the driver of the Perodua Ativa at the Ipoh district police headquarters.

"Upon checking, I identified the driver as a Malay male named Mohd Nazri Abdul Razak. Nazri was also found to be a police officer."

Jong said she conducted an interview and initial investigation with Nazri, who cooperated fully with her inquiries.

"After reviewing the traffic report and his oral statement, I proceeded to arrest him and seize the white Perodua Ativa.

"Following the arrest, I conducted a urine screening test for harmful drugs, which showed that Nazri's urine was negative and free from drugs."

Jong said about 4am on Dec 16, 2023, after completing the necessary procedures, Nazri was placed in lockup for detention.

She testified that on the same day, she received instructions for the investigation to be transferred to the District Criminal Investigation Division (CID).

"I was instructed to assist the CID in handling the case. At this stage, I was informed that Assistant Commissioner Chua Sze Yuan was assigned to take over the investigation," Jong said.

The 28th prosecution witness, Inspector Noor Azlan Zaidin, testified that he did not edit the two copies of closed-circuit television camera footage he received.

Noor Azlan said he obtained the CCTV footage from Masjid Muhammad Al-Fateh, via Borhan Zaharudin, and the owner of a house in Gerbang Meru Indah, on Dec 12, 2023.

When asked by deputy public prosecutor Afzainizam Abdul Aziz during cross-examination whether he had edited the videos, Noor Azlan firmly stated that no editing had been done.

The trial continues tomorrow.

According to the charge, Deputy Superintendent Mohd Nazri Abdul Razak, 45, is accused of murdering Zaharif, 17, in Jalan Taman Jati 1, near SMK Jati, between 11.45am and 12.32pm on Dec 15, 2023.

The senior police officer was charged under Section 302 of the Penal Code, which provides for the death penalty or 30 to 40 years' jail and 12 strokes of the cane if convicted.

The prosecution team was supported by Nasrul Hadi Abdul Ghani, V. Suloshani and Low Qin Hui.

The accused was represented by M. Athimulan, Datuk Mior Faridalathrash Wahid and Aiman Hakim Kamaruzzaman.
