KUALA LUMPUR: FashionValet founders Datin Vivy Yusof and her husband, Datuk Fadzarudin Shah Anuar, arrived at the court complex at 8.35am today.
Vivy, dressed in an all-white outfit, and Fadzarudin, in a suit, were escorted by officers from the Malaysian Anti-Corruption Commission (MACC).
The couple is set to be charged under Section 409 of the Penal Code for criminal breach of trust (CBT) by a public servant or agent.
The charge carries a maximum penalty of 20 years' imprisonment, caning, and a fine upon conviction.
The charges stem from a reported RM43.9 million loss suffered by Khazanah Nasional Bhd (Khazanah) and Permodalan Nasional Bhd (PNB) due to their investments in the fashion e-commerce platform.
The couple will appear before Sessions Court judge Rosli Ahmad.
In 2018, Khazanah invested RM27 million, and PNB RM20 million for minority stakes in FashionValet. However, these stakes were later sold for RM3.1 million.
In December 2018, FashionValet acquired 30 Maple for RM95 million.
On Nov 1, Vivy and her husband announced they would relinquish their positions at FashionValet Sdn Bhd.
They expressed regret over the failed investment and took full responsibility for the situation.
Shortly after the couple's apology, the Malaysian Anti-Corruption Commission (MACC) launched a probe into the RM43.9 million, noting that the funds involved were public funds.
The probe also examined suspicious transactions that occurred between 2018 and 2023.
