O&G firm ordered to pay RM254k for unjust termination

KUALA LUMPUR: A contract supervisor from an oil and gas company has been awarded RM254,273 in compensation by the Perak Industrial Court for unfair dismissal four years ago.

Court chairman Azwarnida Affandi ruled in favour of Azman Isa, saying that Technip Geoproduction (M) Sdn Bhd had unlawfully terminated his employment contract without just cause.

Azman's lawyer, Bhavanash Sharma, said the court's decision was based on clear evidence that the dismissal was unjustified.

"The court agreed that Azman's employment, governed by the oversight of Technip Geoproduction, was prematurely and unlawfully terminated on Dec 12, 2020, based on unsubstantiated allegations.

"The case revolved around Azman's fixed-term contract as a Structural Supervisor for the Long Son Petrochemical Project in Vietnam, where he was employed through a Vietnamese agency, Minh Viet Co. Ltd.

"Despite the involvement of the agency, the court found substantial evidence that Technip Geoproduction exercised significant control over Azman's employment, rendering the company responsible for the unjust dismissal," he said in a statement recently.

Bhavanash said the court's decision underscored the responsibility of employers to adhere to fair labour practices and honour contractual agreements.

He said the court further highlighted that his client was denied a fair opportunity to address the allegations against him, and the procedures followed by the company were not in line with principles of equity and good conscience.

"This award is a significant victory not just for our client but for employees across Malaysia who may find themselves facing similar unjust treatment.

"The ruling reinforces the importance of employer accountability and the need to uphold the rights of workers in all employment relationships," he added.
