KUALA LUMPUR: The Gombak Timur Syariah Lower Court in Ampang, Selangor ordered filmmaker Syamsul Yusof to pay an attendance fee of RM200 to his ex-wife, Ira Kazar.
According to Berita Harian, the matter was decided by Judge Maizatul Aliza Chee Din in a proceeding that took place at 3pm this afternoon.
The syarie lawyer representing Ira Kazar, Mohammad Fadhil Abdul Razak, said that his party requested an attendance fee of RM3,000 because it was troublesome for the defendant (Ira), and that the plaintiff (Syamsul) was not being straightforward due to the taklik declaration outside of court last June.
"The case has been completed, we are here to immediately close the divorce application case filed by Syamsul. The case filed by Ira was also completed on Sept 5.
"Today Syamsul wants to withdraw the application and apply for attendance costs.
"The court has approved and ordered the cost of RM200 to be given.
"I'm just annoyed that the divorce declaration happened in June but action was only taken in August.
"And this was not in referrece to the confirmation of the divorce declaration, but rather the application for a normal divorce.
"That's why we filed in Kuala Selangor. If Syamsul didn't file, then Ira had to do so. Because of this, many were confused.
"Today Syamsul withdrew the case and closed it immediately," he said in the Berita Hairan report today.
Meanwhile, Syamsul's lawyer, Azmi Mohd Aris, said that his side did not agree with the RM3,000 attendance fee demanded by the defendant because he described the divorce process that took place at the Kuala Selangor Syariah Lower Court on Sept 5 had saved time for all parties involved.
"Actually, our side had wanted to withdraw the application today, which involved the divorce claim with the permission of the court under Section 47 of the Selangor Islamic Family Law Enactment (EUUKIS) filed in Syamsul on Aug 19.
"My side has already submitted a notice of withdrawal for the case that was filed. However, Ira, who appeared with a lawyer, applied to the court for an attendance fee of RM3,000.
"For me, what is important now is that both parties have gone to the Kuala Selangor Syariah Lower Court to resolve the issue of taklik violation on the same day and have accepted the decision.
"So, we believe that this matter has somewhat saved time and costs for both parties," he said.
On Sept 5, the Lower Syariah Court of Kuala Selangor confirmed the existence of a taklik divorce declaration by Syamsul against Ira while the couple was still married.
The taklik divorce declaration is pronounced by the husband with conditions of taklik and if the wife violates certain conditions, then it can lead to divorce.
Syarie judge, Mohd Faizal Habib confirmed the matter after the plaintiff Ira, whose real name is Faghirah Fatini Kazaruddin, filed for divorce on Aug 21.
On Aug 19, Syamsul, 40, filed for divorce against his wife, Ira at the Gombak Timur Syariah Lower Court.
Previously, Syamsul and Ira tied the knot on Jan 6 last year in Southern Thailand.
